Nursing Home Revised Regulations

CMS’ revised long term regulations offer the most comprehensive changes since 1991.
HANYS’ comments to CMS urged a tiered approach to implementation because of the volume and complexity of the proposed changes. CMS responded with a three-phase implementation timeline of the regulations outlined in the Final Rule.
- The regulations included in Phase 1 must be implemented by November 28, 2016.
- The regulations included in Phase 2 must be implemented by November 28, 2017.
- The regulations included in Phase 3 must be implemented by November 28, 2019.
The regulatory changes CMS made include simple reorganizing and regrouping of regulations, redefining some terms and adding new ones. Other more impactful changes include expanding requirements for a pharmacy review of medication regimens, mandating an annual, formal comprehensive facility assessment to define necessary services and resources to safely and adequately address resident and patient needs.
