Hospital Financial Law Assistance

HANYS and Greater New York Hospital Association (GNYHA) will host a Webconference on the 2013 Indigent Care Pool (ICP) distribution methodology and the Hospital Financial Assistance Law (HFAL) on Wednesday, June 12, from 1 - 3 p.m.
As provided for in the 2013-14 State Budget, the methodology for distributing the ICP significantly changed for the 2013, 2014, and 2015 pool years. The changes were necessaryto ensure compliance with federal requirements and avoid further federal payment reductions under the Affordable Care Act (ACA). One of the provisions of the new methodology is a reserve of 1% of total ICP in a “financial assistance compliance pool” which will be distributed to hospitals based on their compliance with the HFAL beginning in 2014. Members are aware that their hospital’s compliance with HFAL has been assessed as part of the 2010 ICR audit process. While the HFAL has been effective since January 1, 2007, interpretations of the law have evolved and the associations continue to receive questions from members about its implementation.
