HANYS Overview of ACO Regulatory Activity

In response to concerns expressed by healthcare providers and current Shared Savings Program participants, the Centers for Medicare and Medicaid Services (CMS) published a proposed rule that significantly modifies SSP. Many of CMS’ modifications are responsive to comments expressed by HANYS during the initial implementation of the program. HANYS will issue further comments by CMS’ February 6 deadline.

In this webinar, members will learn more about this rule, HANYS’ comments, and the state’s ACO activity.

Below are highlights from CMS’ proposed rule:

  • ACOs entering SSP under a one-sided risk model (track 1) will now have the opportunity to renew under the one-sided model for one additional agreement period (three years); however, the ACO’s potential sharing rate would drop from 50% to 40% for each subsequent agreement period under the one-sided model.
  • ACOs entering under the two-sided risk model (track 2) would see no change.
  • A new “track 3” option will be modeled after the Pioneer ACO program. An ACO that participates on track 3 would have patients prospectively assigned to its network and would be eligible to keep up to 75% of savings, but would also be responsible for up to 75% of losses.
  • CMS is seeking comment on an alternative methodology for establishing, updating, and resetting the ACO’s financial benchmark.

HANYS submitted comments to DOH on a proposed regulation for certifying ACOs pursuant to Public Health Law Article 29-E, which authorized the Commissioner of Health to establish a statewide ACO program.

As we have continually emphasized, it is critical the statewide ACO program align with the goals of other state reform initiatives, including the Delivery System Reform Incentive Payment (DSRIP) program and the proposed State Health Innovation Plan (SHIP).

HANYS provided comments on avoiding duplicative review of ACO financial agreements, streamlining requirements for ACOs already participating in SSP, providing flexibility to organizations that will be challenged by the proposed governance requirements, ensuring legal protections and state action immunity provisions are robust and clear, and aligning quality performance and reporting requirements with current reporting requirements.

HANYS participated on the state’s ACO workgroup, where we provided input as the proposed regulation was developed and submitted initial comments to DOH last year.
