DOH Update on Flu Mask Regulation

Based on the experience of the 2013-2014 influenza season--the first time the Department of Health (DOH) mandated the wearing of flu masks for certain unvaccinated healthcare personnel--DOH is proposing a series of revisions to clarify issues that emerged as providers implemented the mandate, and issues addressed in online frequently-asked-questions documents.

The proposed revisions include:

  • new definition of “patient” or “resident”;
  • new definition of “influenza vaccine” or “vaccine”;
  • clarification of appropriate documentation of vaccination and specific requirements for personnel employed by multiple employers and student personnel;
  • exceptions for mask use, including services provided outside a patient’s home, speech therapists, and for any person who lip reads; and
  • clarification that facilities may adopt “policies that are more stringent than the requirements of this section.”

The proposed regulatory changes begin on page 36 of the July 30 State Register.
