CMS pauses No Surprises Act IDR process

CMS suspended the federal independent dispute resolution process following a Texas court’s ruling on Aug. 3 that the departments of Health and Human Services, Labor and the Treasury violated the Administrative Procedure Act by skipping regular notice and comment rulemaking. The U.S. District Court for the Eastern District of Texas granted summary judgment in favor of the Texas Medical Association, vacating the $350 administrative fee and challenged portions of the IDR rule regarding batching of claims. New Workers’ Compensation Board inpatient rates
