Metropolitan Jewish Geriatric Center Prevails in OMIG Dispute Over Bed Holds

In a case with broad implications for nursing homes under scrutiny by the Office of Medicaid Inspector General (OMIG) for billing for bed holds, a state administrative law judge reversed a nearly $1 million takeback from Metropolitan Jewish Geriatric Center nursing home for failure to have adequate documentation for bed holds over an extended period. The administrative law judge ruled today that nursing homes are not obligated to retrieve documentation and maintain information from hospitals about the prospects for a patient’s return to the nursing home.
