Executive Compensation and Administrative Costs Regulations Expected by May 16

Governor Andrew Cuomo issued an executive order extending by one month, to May 16, the deadline by which state agencies must promulgate regulations to implement Executive Order #38.

Executive Order #38, issued one day after the Executive Budget was released in January, requires state agency commissioners to establish regulations to address the extent and nature of a provider’s administrative costs and executive compensation.  The order specifies thresholds for state reimbursement of expenses for direct care and services versus administrative expenses, and caps state reimbursement for executive compensation of a service provider.  HANYS will provide additional information to members when it becomes available.  Contact: Nicholas Henley
