SAMHSA finalizes changes to 42 CFR Part 2 – confidentiality of substance use disorder patient records

The U.S. Substance Abuse and Mental Health Services Administration finalized revisions to Confidentiality of Alcohol and Drug Abuse Patient Records regulations, 42 CFR Part 2. The rule reduces delays and burdens in care coordination by more closely aligning Part 2 with the Health Insurance Portability and Accountability Act, while maintaining privacy protections. A list of the changed provisions is available. HANYS continues to advocate for full alignment of the two privacy rules and is seeking clarification in key areas.
