Statement from HANYS President Bea Grause, RN, JD, on S.8485-B/A.9232-B (wrongful death legislation)
Gov. Hochul has twice recognized that the “Grieving Families Act” would be wrong for New York’s patients, underserved communities, healthcare providers and the state. This bill is not in New Yorkers’ best interests.
High malpractice costs, healthcare workforce shortages and patient access limitations already challenge New York state. Allowing for unlimited wrongful death damages would make it more difficult to recruit and retain providers, make it harder for New Yorkers to access care and exacerbate existing health inequities, all while increasing costs.
The latest version of the bill fails to address the governor’s previously stated concerns. HANYS strongly opposes this legislation and urges Gov. Hochul to veto it, as she has wisely done twice already.
