OMIG proposed regulations deep dive

Revisions to New York State Social Service Law 363-d, Provider Compliance Program, became effective April 1, 2020. These revisions were intended to align New York state laws with applicable federal laws, however, New York state regulations were not amended at that time.

On July 13, OMIG published proposed regulations to accompany Social Services Law 363-d. The proposed regulations repeal 18 NYCRR Part 521: Provider Compliance Program, replacing it with a new 18 NYCRR Part 521: Fraud, Waste and Abuse Prevention. This new Part 521 is intended to align the regulations with state and federal laws.

The proposed 18 NYCRR Part 521 is comprised of three sections:

  • Compliance Programs;
  • Medicaid Managed Care Fraud, Waste and Abuse Prevention; and
  • Self-Disclosure Programs.

This webinar will focus on Section 1: Compliance Programs and Section 3: Self-Disclosure Programs.

After this webinar, attendees will understand:

  • the changes, implications and impacts these sections of the proposed regulations pose to their organization; and
  • next steps for submitting comments to the proposed regulations and for internal review and planning in anticipation of these regulations being finalized.
