Understanding HIPAA’s marketing restrictions

As we identify digital tools for engaging patients and improving care, it’s essential to understand the regulations surrounding protected patient health information and marketing. During this session, healthcare legal expert Helen Oscislawski will review HIPAA regulations as they pertain to marketing in the emerging digital healthcare environment and marketplace.

This webinar will cover:

  • the definition of “marketing” under HIPAA and its restrictions;
  • exceptions to these marketing restrictions;
  • HIPAA’s “sale of PHI” restriction;
  • how to properly de-identify data under HIPAA, and how it can be used;
  • the New York laws prohibiting the sale of personal information:
    • Ambulance responders (S4119): bans the sale of patient data or individually identifying information to third parties, except healthcare providers, the patient’s insurer and other parties with appropriate legal authority;
    • status of the New York Privacy Act (S67101A);
  • landmark legal cases, Office for Civil Rights enforcement and lessons learned; and
  • how to avoid the legal pitfalls related to mobile apps.
