Surprise billing: The No Surprises Act and New York's Out-of-Network Consumer Protection Law

The No Surprises Act, enacted as part of the Consolidated Appropriations Act of 2021 and scheduled to go into effect Jan. 1, 2022, protects patients from surprise medical bills when they receive emergency services, non-emergency services from nonparticipating providers at participating facilities and air ambulance services from nonparticipating providers. New York’s groundbreaking Out-of-Network Consumer Protection Law, which took effect in 2015, protects New Yorkers from financial exposure from surprise bills and emergency services.

Join HANYS for a webinar that will explore key differences between the federal and state laws and elaborate on major new obligations imposed by the NSA that will significantly affect hospitals and other providers.

Topics include:

  • differences between NSA and New York's OON law;
  • notice and consent rules;
  • patient cost-sharing calculation;
  • OON payments;
  • independent dispute resolution process;
  • good faith estimates of charges for uninsured/self-pay patients; and
  • other transparency related items.
